Nintendo’s stringent stance on emulation has been evident in recent legal battles. The company successfully took down Yuzu, an emulator for the Switch, in court. Adding to this, Discord has now shut down servers related to emulators Suyu and Sudachi, both of which are derived from Yuzu. This move includes disabling the accounts of the lead developers.
However, while the server shutdown is confirmed, Discord has yet to provide a clear reason for it, leaving the situation somewhat ambiguous. According to The Verge, Discord’s response regarding this matter has been limited so far. Notably, Yuzu faced legal action and disappeared on March 4th, but Suyu and Sudachi emerged soon after.
In response to inquiries, Discord’s director of product communications, Kellyn Slone, told The Verge that the platform complies with all legal Digital Millennium Copyright Act requests. This succinct statement indicates Discord’s approach to handling such matters, although the specific reasons behind the recent server shutdown remain unclear.
The developers received indefinite messages regarding sharing content that allegedly violates intellectual property rights. Discord, however, stated to The Verge that it is following its standard procedure for DMCA takedown requests.

Speculation suggests that individuals might have been sharing Nintendo’s cryptographic keys, firmware, or even entire pirated games on these servers, despite Discord’s policies. Regardless of the specifics, the servers no longer exist, leaving their content unverifiable.
Discord typically doesn’t shut down a server after just one warning, even if there are DMCA violations or potential infringement issues. According to Jarrod Norwell, a developer of Sudachi, nothing illegal was occurring on Sudachi, and they did not violate any infringement rules. Discord vaguely cited intellectual property as the reason for the takedown but has not provided further clarification.

In a post on X (formerly Twitter), Norwell shared the email from Discord notifying them of the account disablement for violating the Terms of Service (TOS). Norwell asserted that he and the Sudachi team always adhere to the TOS.
“Their initial email stated that my account had violated the Terms of Service (TOS), without providing any further details.“
Discord’s copyright policy focuses on content rather than individuals. To remove copyrighted material, a clear description of the infringing content and its location is required. Platforms such as Discord proceed to remove the content. However, users can challenge this takedown with a “counter-notice,” claiming fair use or the absence of infringement. Once a counter-notice is filed, Discord’s involvement ends.
If the original complainant, such as Nintendo, still believes infringement has occurred, they can use the counter-notice information to identify the user and potentially pursue legal action. In this case, Discord’s actions do not seem to indicate an infringement issue. The Sudachi and Suyu communication servers disappeared rapidly.
Certainly, platforms like Discord are not obligated to provide a reason for removing content from their platform. However, even if Discord identified infringement in the content, it shouldn’t result in an entire server being removed. This situation aligns with Nintendo’s recent crackdown on developers through its latest round of takedowns.
